Privacy policy of the Gambio GmbH

Beside the website itself, we operate a number of services on or through our website: A webshop where you can order our products and services as well as a customer portal, where you, as soon as you are a customer, may receive updates of our products and may request and receive product support, and where you can – subject to respective approval of the conditions of our forum– exchange with other customers in a customer forum. Further, we offer live support through our website and a blog, to which you can contribute as an author or comment on other posts. All the above- mentioned involves the exchange of information of various kinds. In the customer forum or the blog also such data will be involved that you have entered yourself in the course of using the forum or the blog and which you have made visible to other customers yourself. To some extent, this information also involves personal data. In this respect, we of course comply with the provisions of the Federal Data Protection Act and the Telemedia Act and will collect and process your personal data only to the extent described in the following privacy policy. On this basis, we explain below in detail, for what purpose and to what extent we collect, process and use personal data.
If you are asked to grant consent in context with our services, you grant your consent by clicking on the appropriate check box or by using the blog comment feature by submitting your comment in that we are allowed to collect, process and use your personal data.

Of course, you can withdraw your consent at any time.
The revocation can be made in writing to the Gambio GmbH, Parallelweg 30, 28219 Bremen. However, for a revocation, an e-mail to info@gambio.de is sufficient. Please note that after a revocation, some of the services and functions will no longer be available to you.

1. Nature and extent of the collection and the processing of personal data

We collect and process personal data if you sign up or log in for individual services of our website and if you want to add a comment or an article to our blog. Further, we store data in a certain scope which result from the use of our website; however, these data are stored in anonymised and pseudonymised form. Furthermore, of course, which you entered after registration in the course of our customer forum and the blog, those data are electronically stored on our servers in order to make available such data for third parties in the scope you wish them to be available.

a) Inventory data, live support, and data in the blog or customer forum

As stated above, on our website there are several services for different purposes. With regard to the (inventory) data collected by us, it is important to distinguish as follows:

aa) The purchase of our products and services in the shop

The purchase of Gambio products in our online shop requires a registration, subsequent to which you receive access data for the customer portal. In this course, we basically request or store the following inventory data:

  • your first and last name,
  • your gender,
  • your address (street, number, zip code, city) and
  • an e-mail address, as well as a phone number where we can reach you for the performance of our services.

We need the inventory data of the customers of our shop in order to identify you as our contract partner, to create and manage your customer account, to deliver the product to you as well as to contact you, if necessary. Also, your registration as a customer, embodied in the inventory data, enables you to access our customer forum (see below). We also use your e-mail address to send you information about our webhosting offers - but of course only, if you have selected the appropriate check box.

In addition to the above-mentioned inventory data, the information on your company as well as your VAT ID number will be collected, if you voluntarily provide this information. If you want to pay by bank transfer, we also receive information about the account from which the amount was assigned to in the course of the bank transfer. We categorize these data as inventory data. If you pay via PayPal, the PayPal privacy policy applies.

Further, you are free to decide if you want to inform us on your complete access data to your webshop (backend of website, administrator area, provider access data, etc.). We will only collect, store and use these data to perform your support requests to which we contractually are bound to, and to help to solve any problems quickly. These data are also used in order to perform other orders which you explicitly requested, e.g. individual adjustments to your webshop.

As a support customer you receive a shop key, that is an identification number, with which we can identify you as a customer. You have the possibility to deposit your Gambio shop key in the administrator area. If you deposit your shop key, we collect and store the following data in addition to the above-mentioned inventory data:

  • the shop key assigned by us,
  • your shop-URL,
  • the exact version of your shop including the version numbers of the installed modules and
  • the language active at the time of the data transmission to the Gambio customer portal in the admin area.

If you have activated the shop key function, the aforementioned data will be automatically and periodically updated. Thus, with regard to your support inquiries it is ensured that we can purposefully and efficiently answer you support requests relating to your current shop and under consideration of the modules installed in your shop. In addition, we use the shop key function to inform you on available updates for your shop via the info-box in the administration area. Under no circumstances, the data will be disclosed to third parties. Moreover, you can end the shop key function by the button "delete shop key" in the administration area. In the Gambio customer portal you have the opportunity to access the shop information submitted to us and to delete them, if necessary.

If you end or do not activate the shop key function, some areas of the customer portal may only be used in a restricted way.

bb) Our blog

Of course, on the one hand our blog is for reading. On the other hand we are pleased if our customers want to enter their own posts. Such posts can be submitted by e- mail. In this context, we only ask for your name. Of course, we receive your e-mail address when you submit a post. We store the above data in order to identify you as a contributor to our blog and to be able to ask you questions with respect to the matter or to forward to you questions of third parties.

If you want to comment on a post in our blog, you can do this by using the input form. There, you are prompted to specify a name - the name is not required to be your real name; you are free to use a pseudonym – and to communicate an e-mail address. In context with your comment, we store this name, the indicated e-mail address and the IP address assigned to your internet connection by your provider at the respective time. The storage of the data only happens in this context. These data will not be stored otherwise, let alone released or transferred to third parties.

cc) Our customer forum

If you decide to activate our customer forum, we additionally collect or store

  • a user name under which you are available in the customer forum and
  • optionally an avatar image and your personal signature.

b) E-mail newsletter

We reserve the right for the future, to send to you at reasonable intervals an e-mail newsletter to your e-mail address, which in addition to editorial information may also contain advertising content related to our products or new services. You will always have the opportunity to unsubscribe from the newsletter, for example, by sending a simple email to info@gambio.de or by clicking on the appropriate link in each newsletter.

c) User data / User profiles / Cookies

Basically, you can visit our website without separate entry of personal data. However, some data will incur due to the use. With regard to such user data, the following shall apply:

aa) In cases our internet pages are visited by registered users or simple internet users, we store specific data in so-called log files. A log file consists of the IP address, the start time and end time of the visit on our pages, the amount of transmitted data, and the sub-pages called via our website. On the one hand, we collect and store the log files for safety reasons, in order to be able to track cases of abuse of our services. On the basis of these data we obtain insight on how our services are used. For example, we learn, which pages are most popular, at what time the use of our services is particularly intensive, how the navigation within the services proceeds etc. The results of this analysis are finally available in static and anonymous form. We use the results for technical and editorial optimization of our services. That means, for example, that we do not know which user behaviour you prefer, but only that there is a user who has such a user behaviour. We have no right and no interest, to identify you as an individual on the basis of an IP address.

bb) Our website uses Google Analytics, a web analysis service of Google Inc. headquartered at 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google"). Google Analytics uses so-called cookies, i.e. text files that are stored on your computer and enable the analysis of how you use our website (for more details about cookies, see item ee) below). The information generated by the cookie about your use of the website (including your IP address) are transmitted to a server of Google in the United States and stored there.

Google will use this information to evaluate your use of the website, to compile reports about the website activity for us and to provide further services related to website activity and internet usage. Google will also transmit this information to third parties if this is required by law or insofar third parties process these data on behalf of Google. On no account, Google will bring in connection your IP address with other data held by Google.

cc) We also use "Woopra", a web analysis service of iFusion Labs, LLC headquartered in Dallas, Texas, U.S.A. iFusion also uses cookies (see bb) above and ee) below), which allow an analysis of your use of the website. The information generated by the cookies about the use of the website (including the country of origin and region, the operating system, the used browser and the resolution) will be transmitted to a server of iFusion Labs, LLC in the United States and stored there.

iFusion Labs, LLC will use this information to evaluate your use of the website, to compile the corresponding information about website activities, and to provide further services to us related to the use of the website and the use of the internet. These data cannot be assigned to specific people. iFusion Labs, LLC will not transfer any personal data to third parties, unless there is an express consent of the person concerned or the transmission is required by law (see also the privacy policy of iFusion Labs, LLC under http://www.woopra.com/privacy/).

dd) Moreover, our website uses plugins of the network facebook.com (e.g. the "like button") of Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, United States. Our respective websites are marked with the corresponding button. If you call our websites with such a plugin, your browser will directly connect with the Facebook servers. The contents of the plugin are directly delivered by Facebook Inc. to your browser and displayed accordingly in the environment of our website without giving us the possibility to influence the contents of the plugin. Facebook Inc. might learn from the user data that is transmitted to the servers of Facebook Inc., which one of our websites you've visited and associate this information with a Facebook account, if you are registered on Facebook or if you have recently visited a Facebook page or other pages containing content from Facebook. If you also actively use Facebook plugins (e.g. the like button), corresponding information will be transmitted from your browser directly to Facebook

Inc., without giving us the possibility to have influence on that. The detailed information on how and in which scope Facebook Inc. collects, processes and uses the corresponding data, can be taken from the privacy policy of Facebook Inc. under www.facebook.com/policy.php. There, you also find information on the setting options you have in order to protect your privacy.

 

In order to avoid that Facebook Inc. collects information about you while visiting our websites, you can log out from facebook and delete cookies of Facebook Inc. from your browser before visiting our websites.

You can object to the collection, storage and use of data according to paragraphs 1. c) aa) to dd) at any time.

ee) Within the framework of our internet pages we also use cookies. Through our cookies we receive the login data, information about your browser type and its version, the date and time of your visit to our websites as well as the cookie number. This use of cookies within the framework of the registration (if required; see above) as well as in the further course of our services allows us to recognize you when you visit our website again after a previous session has ended.

If you want to prevent the use of cookies (also with regard to the information under bb) to dd)), there is a possibilty with your browser to prevent the acceptance and storage of new cookies. To find out how this works with the browser you are using, you can use the help function of your browser or contact the manufacturer. However, please note that the full application security as well as the full application comfort, which we are constantly striving to achieve, can only be achieved by the use of cookies.

d) Content data

Within the context of our blogs and our customer forum (see above), you have the possibility to post articles, images, screenshots, and other content, comment on posts and contents of other customers etc. and to interact with customers. Of course, in this context, we store such content and posts in order to keep them available on demand - and in case you enter personal data in or in connection with your posts, they will also be stored. However, you are completely free to decide, which information you want to tell us about you. The indication of personal content data should enable other customers in the forum to get to know you and to exchange experiences. We make technically available the data entered and released by you at the appropriate locations in the customer forum. The profile entered by you may be also found via search engines on the internet. However, you have the possibility to restrict the visibility of your profile by certain privacy settings on our website and to make it visible only to other registered customers. In no case, your email address or even your password will be visible to the internet public or other registered customers.

After termination of the user agreement your account will be deactivated. However, any other content provided by you will remain basically available. This in particular concerns communications and interactions with other customers. However, you have the possibility to contact us by e-mail and to request the anonymization of certain content.

2. Disclosure of data to third parties / public content data

a) Transmission of information

We only transmit data concerning you to third parties,

  • if and insofar as this is necessary for the implementation of the contractual relationships or for the enforcement of our claims and rights,
  • if there are requests by governmental authorities, in particular by law enforcement and regulatory authorities, and if the transmission of informaion is required in order to prevent criminal offences and maintain public order and security and/or
  • if we are legally obliged to do so.

b) Public availability of the content data

If you want to put it that way, we "transmit" your content data, which you have transferred on our servers for the purpose of uploads to the public by making them technically available on the designated website for all internet users.

3. Links to other websites

Our website contains links to websites of other providers that are not correlated with us. After clicking on the link we have no influence on the processing of personal data (such as the IP address or the URL where the link resides) which might be transmitted to third parties by clicking on the link, since the behaviour of third parties naturally is beyond our control. Therefore, for the processing of such personal data by third parties we cannot assume any responsibility.

4. Disclosure, correction, deletion, blocking

Upon your request in writing or if communicated in textform, we will disclose to you at any time, which personal data concerning you are stored with us. Further, you have the possibilty that we lock or delete such data at any time. Only such data are excluded from deletion, which we require for the processing of pending requests or for enforcing our rights and claims, as well as data that we need to store in accordance with statutory regulations.

5. Security

We use technical and organizational security measures, to ensure that the personal data of our users are protected from loss, incorrect changes or unauthorized access of third parties. In any case, as regards access from our side, only authorized persons have access to your personal data, and only to such an extent as is required in the context of the above mentioned purposes.

In the event of any inconsistency between the German and the English version the German version shall prevail.
